  • Can I press charges on my daughters17 year old ex boyfriend for having sex with my 15 year old daughter?

    Angelo’s Answer

Absolutely. You need to contact your local police department immediately, relay the details. They will come and interview your daughter about the sexual contact and will proceed accordingly.

  • Cash seized

    Angelo’s Answer

I need a bit more information to adequately answer your question. Who confiscated and is holding your $4000? Did this occur while going through customs, or simply TSSA checkpoint? Were you held and questioned for any reason?

  • Does being on an opoid pain managment progran years before my current accident hurt my current injury case?

    Angelo’s Answer

No, it should not necessarily hurt your case. A qualified legal counselor will be able to distinguish old pain from new injures and pain though your medical care providers. A thorough review of your medical history will be necessary, even potentially scrutinized, but your prior medical conditions should not always reduce the value of a present-day case.

  • Trip and fall injury at a Big Box store. Store refuses to pay for my injuries.

    Angelo’s Answer

First and foremost, you should contact viable legal counsel immediately. You suffered a serious injury and it appears, such most likely occurred because the store was negligent. The rug may not have been secured in it's location, or the correct size, shape and fabric, to make it reasonably safe. Good counsel will get your bills paid and potentially a financial settlement for the injuries you sustained. I hope you heal well, stay safe. If you have further questions, do not hesitate to reach out. -Angelo Rose

  • My boyfriend is on parole, he had police contact, will he get violated and sent to jail at his parole check in?

    Angelo’s Answer

Whether he gets arrested or not will be wholly up to his PO. Him not showing up for court was probably not the best decision, even under new bail reform laws. I would advise him to come clean with his PO, call him and report what happened. For a small amount of week (assuming it is just a UPM charge?), his PO can choose to not violate and order testing and/or treatment instead.

  • If you are on mail in probation do they still do home visits and will they drug test you?

    Angelo’s Answer

When you go on probation, you typically give up virtually all constitutional protections against search and seizure. In this instance, it is my sincere believe that as long as you remain on probation, even if it just a "phone in" procedure, you are still subject to home visits and potential drug testing.

  • If someone has a warrant for probation violation but has a bond does that mean they wont do time?

    Angelo’s Answer

Court must first acquire jurisdiction over your boyfriend. He may very well do additional time (consecutive) time on the probation violation but if you hire legal counsel in AZ, that counsel should work in conjunction with legal counsel in TX for a potential global resolution that would entail concurrent jail time (time running together on both charges).

  • Who do you petition for early release of probation? How soon can you do it?

    Angelo’s Answer

If you have had no violations, your probation officer should petition the court/judge who sentenced you for early termination. Without your probation officer's approval, early term can not happen.

  • How accurate are marijuana blood tests? (particularly for habitual users) How can blood tests be suppressed?

    Angelo’s Answer

Blood tests are arguably the most accurate determination of THC in an individual's blood stream, BUT that is virtually meaningless. Chronic users have a baseline (as noted here) with no viable side-effects or impairment. I would hire local counsel to further investigate the actions of the police officer how formed his common law opinion.

  • Are asking defendants about case law fair game interrogatories?

    Angelo’s Answer

It would be improper for case law or legal authority to be cited or questioned during Interrogatory phased. Interrogatories should be utilized to seek facts, not law.
