  • What documents should I take to my AOS interview

    John-Philip’s Answer

We typically recommend bringing all original documentation of marriage certificate, State Identification, birth certificates, etc... We would recommend bringing a copy of the applications that you have submitted and any new evidence. I agree, I also would recommend reaching out to an attorney in your area to review your documentation, do a mock interview, and provide guidance as to what kinds of updated evidence you could supply. If you are nervous, I would even recommend having an attorney attend the interview with you.

  • My H1B Offer Letter base salary is lower than the amount mentioned on LCA. But including bonus , it exceeds LCA amount?

    John-Philip’s Answer

Your employer is required to pay the prevailing wage or the actual wage paid by the employer to workers with similar skills and qualifications, whichever is higher. Generally, if any documentation provided at the interview that is lower than the amount mentioned on the LCA and there was not an explanation, this may cause an issue during your interview and later consequences for your employer. I would strongly recommend that your employer contact an attorney to avoid any future issues for their company and beneficiaries.
