When the owner purchased their condo, he agreed to abide by our HOA Bylaws. Even if he makes Chapter 13 payments, the owner would still have unpaid delinquent assessments. Can a BK judge rule against our Bylaws?
I presume if the owner decides to keep the condo, he will pay the delinquent assessment. You will have to give him time as per confirmed court plan, to cure the defaulted assessed amount.
