Congress added Qualified Personal Residence Trusts ("QPRTs") to the law in 1989. A QPRT is designed to transfer the principal residence, and up to one vacation residence per parent, to the children at a reduced - and usually no - gift tax cost. A Family Limited Partnership is an excellent structure to protect investment assets. It is also a superior way to achieve valuation discounts for estate tax planning. This is a litigious society. We want to protect our assets from problems that might occur in the future. The ability to protect some assets is limited, e.g., homestead exemptions in some states are limited to a dollar amount.
