Garnishment of wages by Wells Fargo Financial where the vehicle was returned to the dealer - resold and $15,000 still remains.

My sister and her husband recently discharged most of their debts and are in credit counseling. They had purchased an expensive truck ( about $42,000) and had financed it with Wells Fargo Financial. They turned the truck back to the dealer who resold it for about $15,000 less than their original loan. Wells Fargo Financial is now garnishing my sister's wages for $1200.00 per month until the $15,000 is paid off. This leaves them nothing to live on after their mortgage payment. My brother-in-law is now on disability because of a disease that he will eventually expire from. They would like to set up a payment plan with Wells Fargo Financial, but Wells Fargo will not listen to them or offer to help in any way. Are their any options for them? They have offerred in good faith to try to work this situation out. My sister has an excellent job with the US government. In addition to making the $1200/month payments. Every 3 months she has to pay $75.00 for Wells Fargo to garnish her wages again. She is at her wits end and does not know what to do Thank for any advice that you can give.

Supervised Visitation

My ex husband and I have been divorced for 3.5 years. Since that time, he has been federally convicted of selling drugs. He is scheduled to be released from prision in 6 months and is wanting visitation. I am not comfortable with him having visitation. In order to have his sentance reduced, he was an informant for the federal government. He testified in court in front of other drug dealers. Not only am I concerned about him but I am concerned that she would be in danger if she were with him. Do I have the right to demand supervised and limited visitation without having it court ordered?

false claim for child support

I checked online (lake county, Florida) and saw that there was a petition filed as follows "Department of Revenue Administrative Support Order ", is this child support?
If so the petitioner that submitted the claim knows that I am not the father of the children (this was proven by DNA some years ago), what actions can I take to protect myself and is there any specific suit that can be filed against the petitioner for this false claim?

Child Support

I am a 24 year old soon to be graduate with a Bachelors Degree (talking December 18th, 2008). I am currently expecting a child with a faculty member from my college. During the time I became pregnant we were dating, but he cheated on me with another student from my school, and eventually broke up with me before I realized I was expecting.

He is unwilling to support me in any way because he is afraid of losing his job if the college finds out (it violates the no fraternizing policy in place) and I will be unable to get a job in my field due to the fact that very few and far in-between will hire someone who is due in 3 months from the date of hire. I was unable to work and go to school at the same time so I quit my job for my last quarter (11 weeks) of college so I could graduate. I didn't want to put off college any longer and I figured a degree is better than no degree after the child is born. I will be losing my medical coverage from my parents as of January 1st, 2009 and have since taken out a COBRA to cover me until the birth of the child for medical visits regarding the pregnancy and delivery.

He said he is not going to pay me anything because he does not feel it is his job to. He insists I take free state coverage from the government programs offered here, however the facilities are not local for me should I go into labor early or on time, nor are they adequate because it is a public hospital. Can he be held responsible for providing some or all of my medical coverage/support?

My second concern is that since he found out I was pregnant he has only contributed $300.00 total in the past 6 months towards the prenatal care and items I have received which has totaled over $1000.00 of my own money. He told me prenatal vitamins and supplements were not a necessity he should split the cost for along with other comments towards the expenses that I was told (by my doctor) were necessary. Is he responsible for any form of support or costs/co-pays for the prenatal care or cost of the baby expenses?

My third concern is child support after the child is born. He has shared with me several times while we dated the average salary the man makes. He has two jobs through the college. One is a full time professor and the other is a part time online education professor. He makes approximately between $70-90K a year, but tells me he will be unable to adjust his expenses and lifestyle to provide child support. He said he is willing to give only $100-300 a month which does not seem right to me considering the income he makes. He said he can not afford a child, but my father has raised and supported a family (5 including himself) and makes his mortgage, home equity loan, college loans, credit cards, 401K, insurance (health and car) and house utlities every month on a salary that is only $50K. However the father-to-be has recently paid for a new $2,000.00 computer and car expenses (paint job/fender repair), yet stills tells me he can afford much. Red flags are going up and I want to know what legal actions I can take should he try and avoid his responsibilities. Please help, I have no idea where to start.

Clothing Line Trademark

I'm starting a clothing line called ''GROWN APPEAL" my logo is "GA" but i know that GA is short for the state of GEORGIA, so my question is:

Can i still use GA if i add designs to the letters to make it look more towards my clothing line?

I have search for my name "GROWN APPEAL " on via the Trademark Electronic Search System ("TESS")
and didn't find the exact name, but i did find:
"Grown and sexy clothing"
"Grown men"
"Hoodgrown apparel"
"Grown folks Apparel"
"SoulGrown"
"Cali Grown"

How high is the risk of rejection of my name, "GROWN APPEAL" if i apply for a trademark?

Alot of my desings will have well know qoutes, such as:
"Clock Work"
"Catch 22"
"Heartless"
"The Constitution"
Can i still have these designs on my shirts, or would i still have to get approval?
ps. But it is really hard to find the author.

What are my rights against a creditor suing me for old debt

I am being sued by LVNV Funding, which claim to have had several attempts in contacting me about a debt that I owe on. The last time I spoke of this debt was almost three years ago and when I tried to make payment arrangements, they would not accept any payment offered. They wanted me to pay off a fourteen-hundred dollar debt in three payements. The person that was handling my "case" stated that "I had already had the opportunity to make the the payments on a monthly bases." So, if they didn't take my money then, why do they want it now. I have a hearing set for January 2009 and need advice on what to do to win this case and get them to stop harrassing me. Please help.
