Legal NewsWoman Slips on Vomit, Sues SearsThursday, September 17, 2009 at 03:18 PM A woman from the Chicago area is suing the mainstream department store Sears after she slipped on vomit in the store last July.
Glinda Bridgeman filed suit this week in the Cook County Circuit Court alleging she sustained serious injuries when she lost her balance on a mound composed of paper towels and vomit, which was negligently left on the ground by store management, Chicago's CBS affiliate WBBM-780 reports. Court documents state that the shopper was browsing the television of Sears' store at 6501 W. 95th St. in Chicago Ridge when she fell. The suit, which asks for more than $50,000 in damages, asserts that Sears management was negligent for failing to warn customers that a potential hazard was left unattended in an area that was a common footpath for customers and employees. According to the Phillips National Injury Group, slip and fall cases of personal injury often boil down to the question whether the dangerous condition which produced the fall was foreseeable. Some jurisdictions allow the jury to address this matter , while others apply objective legal standards. ![]() |
