Anonymous Comment: How does step 2 - eviction litigaiton start. Does the landlord file the notice? If so where and to what court? Do I need an attorney? If so where does one find one?

I have a question: My tenant is month to month, now, and you say to file a 20 day notice for month to month, but since he is 10 days late on the rent now, which the previous lease set as the late date, do I not have the option, if I choose, to do the 3 day pay or quit to get him out as quickly as possible?

ngquehuong’s Comment: Please advise which court should the eviction notice is filed and since the tenant is late to pay the rent for a month, do I still file a 20 day notice for month to month. Thanks.
