Lawyer’s Comment: Everyone who is convicted of DUI/DWI in New Mexico must install the Breath Analysis Ignition Interlock Device (BAIID or "Interlock) for one year. Second convictions are 2 years and third convictions are 3 years. After 3 convictions you are looking at a minimum of six months in prison as a felon and the Interlock stays on for a term of years after which you must petition the district court for permission to remove the device.
