Divorced or Separated Parents: Who gets to claim the Kids as Dependents on Taxes

kmk1226’s Comment: I am a custodial parent and have joint legal custody with my ex husband. We were divorced in 2004 and the only thing the agreement states about claiming dependents is this: "For tax purposes, Jon Jr. will be claimed as a dependent of Jon Sr."
There is nothing specific as to what year or years, and nowhere does it say I will not claim him in the future. I understood it at the time that I was releasing the exemption for that year only.
Now I've gotten a letter from the IRS that he (I assume) is claiming my son as well. Can he win by trying to say that I gave up my rights indefinitely.

Who is right?
