Call The PoliceIt is important that the police document your accident. The officer should obtain the information about the other driver, owner and insurance company, which will be important if you need to pursue a claim. 2
Get Medical TreatmentMany times victims reject medical treatment or transport to the hospital. This is usually a mistake. Insurance companies will often point to the lack of hospital trip as evidence that you were not hurt. Under Florida law, your own insurer will pay at least 80% of the cost of medical treatment, so it is better to get "checked out" and have your injuries documented early. Be sure to tell the doctors/nurses ALL of your symptoms and complaints, and don't try to be tough about any injury you have. Be sure to follow-up on the medical recommendations for treatment. 3
Get PhotographsYou should photograph all the vehicles before they are repaired, if possible. If any of your injuries are visible, you should also photograph them. If the scene of the accident contains skid marks or obstructions that may have contributed to the accident, you should photograph those as well. Personal injury claims from auto accidents can take months or even years to resolve, and these things change and/or disappear over that time, so it's important to document them with photos. Do not be shy in taking photos. You can not have too many. 4
Do Not Talk To Insurance CompanyYou will have to report the accident to your own insurance company, usually within 24 hours of the accident. They may wish to take your statement concerning the accident and your injuries. If you have an appointment with an attorney by this time, you should defer the statement until you have spoken with the attorney. They may also wish to record your statement. They will require your permission to record your statement. Under no circumstances should you speak with the other party's insurance company until you have consulted a personal injury attorney. 5
Call A Personal Injury AttorneyYou should not waste any time in contacting an experienced personal injury attorney. Insurance company employees are trained in handling claims, and you are at a significant disadvantage in any discussions with the insurance company. Getting with an attorney early will insure that your claim will be handled correctly, and the attorney can prevent you from doing or saying something that could destroy or minimize your claim. Cases involving automobile or motorcycle accidents are typically handled on a contingency fee basis (no recovery, no fee), and most personal injury attorneys offer free no-obligation consultations. Take advantage of this and find out your rights as soon as possible. Additional ResourcesTo speak with the author, call (352) 795-0404 or visit www.KeithTaylorLaw.com.
