How Does It Work?In CA a dui case breaks down into 2 charges: driving under the influence (count 1) and driving with a BAC over .08 (count two). In the Helmondollar switcheroo you plead guilty to count 2 and the DA dismisses CT 1 in the interests of justice after a short (15 minute) trial. Driving at .08 or over breaks the law but doesn't prove you were under the influence. So you admit to that, the DA can't prove dui and the case is dismissed. Note: only useful in the weakest cases of dui. 2
Wet or Dry Reckless AlternativesThis involves your pleading to reckless driving while drinking or not. The first case is obvious, the second comes up with drug users. A wet or dry reckless is not as serious as a dui but it will be counted as one if you are arrested again within 10 years. For the time being your fines and penalties will be less.
