What is probate?

Posted by attorney Joy Owenby

In Florida, if an individual passes away and they own assets (real or personal property, financial accounts, life insurance ...) that are not jointly titled and do not have a beneficiary designated, you must probate these assets. Probate is the process of clearing title to these assets by filing a petition for administration in the county the decedent resided in at the time of passing.
