Sex torts include civil lawsuits for intentional or reckless behavior leading to the exposure and/or contraction of sexually transmitted disease. Whether the disease is herpes or something more deadly, like AIDS; key factors include whether the person transmitting knew or should have known they carried the disease, whether they took any precautionary measures to prevent infection, and whether the party being infected was informed of the possibility of exposure.

Historically, for one reason or another, sex torts were neither common nor lucrative lawsuits. But that is changing as courts recently have awarded damages of greater than $10 million in extremely reprehensible sex tort cases.
