What to do if the employer fails or refuses to report an injury.Call 919-807-2506 (Industrial Commission) and get a Form 18 (which you can get from the Industrial Commission). They will assign you a file number. Mail the form 18 to: NC Industrial Commission, Statistics Section 4334 Mail Service Center, Raleigh, NC 27699-4334. Mail the first copy to your employer certified mail, return receipt requested, and keep the receipt (as proof). Keep a copy for yourself at home. 2
Medical TreatmentThe employer usually sends injured workers to their official medical provider. If the employer refuses to help you with medical treatment, you can choose your own physician/hospital, but must promptly request the Industrial Commission's approval. For example, you are severely injured and then go to the ER, and then go to your family doctor - you must let the Industrial Commission know otherwise you can jeopardize your WC claim.
