Suspecting abuseThe first signs of nursing home abuse or neglect often include emotional distress or physical distress, or both. If your loved one seems depressed, unusually withdrawn, outwardly upset, or fearful, you may suspect abuse. If your loved one doesn't appear clean or well nourished, you may suspect neglect. Specific signs of abuse or neglect include bedsores, bruises, weight loss and dehydration. The list goes on and on. At the beginning, it may be impossible to know for sure whether your loved one is being abused or neglected, or if their symptoms are a result of an illness. The best thing to do is trust your instincts and look into it right away. 2
Taking actionIf you notice signs or symptoms of abuse or neglect, take action right away. The first step is to talk to the caregivers. Explain your concerns and ask what is being done to treat the issue. If you notice depression, ask what they are doing about it. If you notice that your loved one is not eating, ask what their plan is to make sure they're properly nourished. Ask how often they are monitored, fed, bathed, and how often their sheets are changed. Try visiting during off hours to see if the care is consistent. Whatever action you decide to take, do it right away. Symptoms can worsen quickly, especially in elderly individuals. Bedsores can start small and progress to a dangerous infection if not treated right away. 3
Hiring an attorneyIf your family member or loved one is in a nursing home in Lake County, you should look in Lake County for an attorney. If you're unsure of whether you need an attorney, the best thing to do is sit down with one and ask them. Explain your concerns and see what they suggest. They should have the experience to know if a lawsuit is the right step for you to take. In order to get the best advice, find an attorney who has experience in nursing home abuse and neglect cases. And make sure they work in Lake County. It's important that they are part of the Lake County legal community, meaning they appear in court there often and know the judges and other attorneys. The relationships they will have established can work to your advantage. 4
Filing a lawsuitIf you decide to file a lawsuit against a nursing home in Lake County, you will file at the main courthouse in Waukegan, which is at 18 N. County St. This is where a trial will be if the case goes that far (if it's not dismissed or settled beforehand). Prior to a trial, there will be case management conferences and hearings. Your attorney must attend these, but you are not required to appear. Before hiring an attorney ask them what their strategy would be for your case. If they have the necessary experience, they should be able to answer all your questions about the litigation process.
