8-4-081 Public urination or defecation:

Any person who urinates or defecates on the public way, or on any outdoor public property, or on any outdoor private property, shall be guilty of a misdemeanor and shall be fined not less than $100.00 nor more than $500.00, or incarcerated for no less than five days and no more than ten days, or both fined and incarcerated. This ordinance shall not apply to use of a temporary or permanent structure or enclosure erected outdoors for use as a toilet facility.


If you were cited unfairly, fight the Citation!!

The Officers written narrative on the ticket suffices for sworn testimony. In plain English: The Officer who cited you does not have to be present in court for you to be found liable.


Any witnesses that can corraborate your story are always helpful.

The more witnesses the better.


Always go to your court date or send a representative.

This is the biggie. If you blow off the court date you will be defaulted with and given a $500 fine + $40 in court costs - OUCH!! If you cannot appear have someone appear on your behalf.
