Family Court in New York is a Court that is competent to determine child custody and visitation access schedules. Family Court has limited jurisdiction which means it can only hear certain types of Family Law cases. For instance, you cannot obtain a New York divorce from Family Court.
The first and most common action you will see in New York State Family Court are actions filed under Article Six of the Family Court Act, and in those actions the Court will be petitioned to make a determination and Order as to the custody and visitation of your children.

The second petition that can be entertained in Family Court has to do with a Family Offense Petition. In an Article Eight Family Offense Action, a member of the household seeks protection from the family court when they feel a crime has occurred in the home and they seek an Order of Protection. In order to hear a Family Offense you must allege a crime has occurred by a family member in your household. Under those circumstances the Court may even order one or the other of the spouses out of the martial residence until a further hearing can be had. You may file a family Offense petition on your own or through a New York State Family Court Lawyer or other lawyer in New York, though it is preferable that you choose a lawyer that has experience in the arena of family law or matrimonial law.
