Lawyers do not make the decisions for clients.
Lawyers provide the legal information so that clients can make the decisions themselves. Clients have the right to have their lawyer explain the law and their options to them in language they can understand so they can make an informed decision. Make certain you clearly explain to your lawyer the outcome you would like in your case. The lawyer will explain more about the law and the options available to you so that you can make a clear goal. However, keep in mind, circumstances arise which may make your goal change.
Ask Questions and Listen to Your Attorney's Suggestions
Don't be afraid or shy to ask questions if you don't understand something your lawyer says or explains. Lawyers are used to dealing with questions. Lawyers are not mind readers and are not always able to tell if someone doesn't fully understand their explanation. You have to understand all of the information your lawyer gives to you so that you can make appropriate decisions. Make a list of questions you have or information you want to give your lawyer before you call or meet with them. Lawyers need their clients to tell them the facts and details relevant to that case - and many times that involves bringing specific documentation (i.e. contracts, orders, bills and receipts) or any other information that you think may be relevant. That way both of you can make the best use of time and make sure you don't forget anything. There is a reason for everything. This means if you are told to stop using all social media - such as Facebook, Twitter, etc. you need to do so - immediately.
If you do not remember something, its ok to simply state that you do not remember. Do not make up any part of the issue or story. If you are not truthful, it can affect you negatively. Tell your lawyer everything - no matter how small - even if you think it's bad or unimportant.
A lawyer cannot guarantee to you what will happen in court or in negotiations with other parties. There are a lot of factors that can affect how long your case will take and its eventual outcome. You need to talk with your lawyer so that you have realistic expectations about the timing. Remember that every case is different - do not expect that because your friend's case was handled within a certain timeframe or achieved a certain outcome, that yours will be too.
You are not the only client and/or case the lawyer deals with on a daily basis. Lawyers juggle not only clients, but also meetings, negotiations and court schedules. They are not ignoring you. Give them an opportunity to get back in touch with you. Many lawyers will have their legal assistants return their clients calls to see if they can assist you. If you have not heard from your lawyer - or their assistant- in a couple of days after leaving a message, call back again. Some lawyers give a set day that they will return phone calls to clients.Be realistic about what a lawyer can do for you.
Problems and Realistic Expectations
Talk to your lawyer when you have a problem with the service you are receiving or a concern about your case. Problems cannot be solved if you keep them to yourself. Be realistic about what a lawyer can do for you. Lawyers are not magicians = they cannot restore a marriage or return your life to what it was previously. Above all, remember that lawyers are people too. They have families and other obligations in addition to you and your case. Be patient. Your problem was not created overnight and will not disappear overnight either--even with the help of a lawyer.
