If you've recently been injured in a car accident, you need to read this article carefully.You may not be aware of the fact that the Florida legislature made drastic changes to Florida's Personal Injury Protection (PIP) law last year. These changes went into effect January 1, 2013 and may already be effecting you!
The most drastic changes to Florida's PIP law involve a 14 day statute of limitation and a potential medical expense cap of only $2,500, unless you are determined to have an “emergency medical condition." What does that mean?
Under the 14 day statute of limitation, if you've been involved in a car accident (regardless of whether you were at fault or not) you must seek medical care from a hospital, emergency transport, medical doctor, doctor of osteopathy, chiropractor, or dentist within 14 days of the accident. Should you fail to seek medical care within those 14 days, your insurance company is not required to pay for your medical bills.
The other big change surrounds how much medical coverage you are allowed. Under the previous PIP law, if you were in a car accident, you were allowed $10,000 in medical coverage regardless of your condition. Under the new law, you may only be allowed $2,500 in medical coverage if you are determined to not have an "emergency medical condition." However, you can attempt to regain the maximum $10,000 if you are diagnosed with an "emergency medical condition" by a medical doctor, doctor of osteopathy, dentist, medical doctor's physician's assistant, or an advanced registered nurse. If, at any point, you are diagnosed with an "emergency medical condition," then you will be entitled to a maximum of $10,000 in medical expenses.
