Your driver’s license will automatically be suspended 40 days from the date of arrest (or the date you were served with the notice, whichever is later) unless you or your attorney requests a hearing in the manner prescribed by law.
1
Act Fast
The license suspension is automatic unless you request a hearing on the issue, in writing, by phone or fax, within 15 days after receiving notice of suspension from the arresting agency on a Department of Public Safety approved form (generally received on the day of arrest). If a hearing has not been requested in time, the suspension will automatically begin on the 40th day after notice was received. If a hearing is requested, no action will be taken regarding suspension until after the hearing and all appeals have occurred.
2
Hire a DWI Lawyer
If you hire a DWI lawyer within 15 days, the first thing they do is request the hearing for you. A good DWI attorney knows to always request a hearing by fax, and keep the confirmation sheet. They will also request the breath test operator, technical supervisor, and request discovery.
3
Always Keep Your Temporary Driving Permit on You
This will act as your drivers' license while you are waiting on your hearing. Your license will be good all the way, and until an administrative judge says otherwise.
