No judge knows your family as well as you do. So protect your family in case of your incapacity by creating an estate plan that uses all legal means to carry out your wishes.
1
Create a will
In case of your unexpected death, a will in Texas allows you to name the person who will care for your children and their money, allows you to delay your children getting your estate until they are old enough to handle it, and allows you to remember your loved ones and charities as you desire.
2
Sign a health care power of attorney
Does your husband faint at the scent of a doctor's office? Choose the most rational decision maker for your health care when you are unable to do so yourself - someone who knows and shares your values. This document only goes into effect when you yourself are unable to make your own decisions. When paired with a directive to physicians (living will) these documents also allow you to control your end of life treatment.
