First Time Drug offenses can be dismissed under Conditional Discharge
Under OCGA 16-13-2, first time drug offenses can be dismissed under a kind of first offender treatment program. Most lawyers know this.
But other non-violent crimes can also be dismissed under Conditional Discharge
Most lawyers do not know that this same conditional discharge provision can result in dismissal of other non-violent crimes which do not directly involve drugs when the criminal conduct is the result of or motivated by drug addiction. A burglary, for example, could be dismissed under this drug code provision even if no drugs were found at the time of the arrest if the attorney can show that the defendant was in the grip of a drug addiction that caused them to break the law when they normally would not.
