How to get a Child Support Case Heard in Florida through the Department of Revenue (DOR).

This guide will explain how parents can receive free legal help though the State in order to establish and enforce a Child Support Order in the State of Florida.

What is the Florida Department of Revenue and How Can the Agency Help Me?

The Florida Department of Revenue has administered the Child Support Enforcement Program since 1994. Department staff provide child support services in all but two Florida counties. The guidelines encourage fair and efficient settlement of support issues between parents and minimize the need for litigation. Effected January 1, 2011, Section 61.30(2) Florida Statutes, which addresses imputed income to calculate child-support. The services provided include: Proving paternity, Getting child support orders, Enforcing child support orders, Changing child support orders and intercepting the Tax return to pay arrears from a Non-Custodial Parent (NCP). Once the Child Support Order is established, and an Order is entered, it is enforceable in your County, and throughout Florida, and also anywhere in the country. The usual time frame from start to finish in a normal case is 1 year. There is never a charge for services from DOR.

Child Support Enforcement

There are legal steps you can take if a NCP stops making payments.Federal laws allow the interception of tax refunds to enforce child support orders. Other methods of enforcement include wage attachments, seizing property, revoking the paying parent's driver's license and ultimately, 5 months and 29 days in jail. In addition, the NCP may have trouble traveling. If you owe $2,500 or more in child support, you are not eligible to receive a U.S. passport. You should make arrangements to pay the state where child support is owed BEFORE you submit your application for a U.S. passport. All questions about your child support arrears or the status of a payment should be directed to the appropriate state child support enforcement agency. The state can suspend any other type of license you might hold. This can include professional licenses necessary to conduct business, to include the license of doctors, lawyers, Insurance agents, and commercial fisherman.
