DUI Reports by police officers are never unbiased. They are created to aid in the conviction of the defendant. Keeping in mind that field sobriety tests are not scientific whatsoever, the Indications of Sobriety method gives a better understanding of your DUI case.
1
Review the report without reading the FSTs
See what the case looks like without the FSTs being discussed. Even defense attorneys are frequently misled by tests they know are not scientific.
2
Write down all the things your client did right
You need to be trained in what officers are looking for. Then, knowing the things your client did right becomes much easier, as little of it will be provided in the report.
3
Know your client, apply, and resolve
Apply the detailed history of your client to the observations and indications of sobriety. Negotiate the case and be prepared to go to trial when you think the state is not making a fair and reasonable offer.
