This short guide explains how the typical contract is structured between an injured person and thier attorney.
1
How Injury Lawyers Are paid
One advantage to making a claim is the way that legal contracts are structured by personal injury attorneys. These contracts are called contingent fee contracts, meaning the attorney only gets paid if he or she is successful in winning compensation for the injured party. The way that my contingent fee contract is written shows that I front all of my time and all of the necessary case expenses. If I am successful and win the case for my client, then—and only then—am I paid a percentage of the recovery and reimbursed my out-of-pocket expenses. If for some (unlikely) reason I am not successful in winning a case, then my client does not have to pay me any fee or reimburse me for any of the case expenses.
My clients do not have to write a check for a retainer fee when they hire me, nor do they receive a bill from me each month. Instead, my clients are never out any money to hire me and they don’t ever have to pay me a dime unless I win their case for them.

Why Contingent Fee Contracts Are Great
Contingent fee contracts allow all Texans—regardless of their financial situation—access to the legal system. Without these types of contracts, there would be no way for the average Texan to be able to afford a lawyer to fight the insurance company and its own army of high-priced lawyers
