Although in this area of law I recommend that you hire an attorney, since not every one can afford one, this legal guide was written to help the thousands of women that have been abused by their spouses, and cannot get legal representation. Always remember that you have the right to call the police
1
Prepare the Ex Parte Petition and attached any affidavits
Even though you are testifying in front of the court, you need to have all the documentation sworn by a notary and attached to the petition so that the court can have documentation of the abuse.
2
Prepare a Notice of Hearing and have it served on your spouse
Ex Parte Protective Orders are only valid for 14 days and there has to be a hearing to make the temporary order a permanent one. Please do not attempt to serve this yourself, hire a process server to do it for you or the sherif department.
3
Register the Ex Parte Order with the county
This is what protects you from your spouse because the police would have access to the order and could place your spouse under arrest if he violates the order.
