How to file a challenge to a local government land use decision under the Growth Management Act

Determine which Growth Board has jurisdicition
There are three Growth Management Hearings Boards:
Eastern Washington: East of the crest of the Cascade Mountains and planning under RCW 36.70A.040.
Central Puget Sound: King, Pierce, Snohomish and Kitsap counties and the cities within those counties.
Western Washington: West of the crest of the Cascade Mountains and not in the Central Puget Sound Board’s boundaries which are fully planning under the Growth Management Act.

Determine if you have standing to file a challenge
To file a petition a person or organization:
1) Must have appeared before the county or city regarding the matter on which review is being requested; or
2) Be certified by the governor within 60 days of filing the request with the board; or
3) Be qualified under RCW 34.05.530 (the state Administrative Procedures Act).

File a Petition for Review in the time allowed by law
Petitions relating to adopted comprehensive plans, development regulations or amendments must be filed within a short amount of time after the city or county publishes its notice of adoption. The time period is specified by law. Check the Boards' website for their handbook which contains information on how to determine by when you have to file or consult an attorney.
