First advantage:

To the extent your spouse has spent any money on the affair, that money MUST be reimbursed to the marital estate for “equitable division”. So, even though the money is not physically in the bank account, you will be reimbursed for the money your spouse spent that should have been yours.

Second advantage

While I strongly encourage clients address sensitive issues in the privacy of an attorney’s office, and issues that could cause embarrassment don’t really need to be aired in the courtroom or local papers, sometimes when sensitive issues are present in a divorce or parentage case, both parties are very eager to enter into good faith negotiations and resolution can be had very quickly.
