The Case File Belongs to You, Not the Attorney

Although an attorney maintains the case file, and prepares many of the documents that go into it, the file belongs to the client. As such, if the client opts for new counsel, the client has the right to the case files. If the attorney wants to retain a copy of the file, the attorney can make a photocopy.

Is the Attorney Required to Turn Over the Case Files Even If the Client Has An Outstanding Balance?

The client has a right to the case files regardless of how much he/she/it may owe the attorney.
