1) Review your employment agreement.
2) Is there a condition that you must complete the year in order to receive the bonus?
3) Is the language in the contract ambiguous?
1
Review your employment agreement.
If you are entitled to a bonus then there is likely an employment contract or other document which explains what conditions must be satisfied in order for you to receive the bonus. If you don't have a copy of this agreement, ask the Human Resources department for a copy or consult your employee handbook.
2
Is completing the year a condition to receiving your bonus?
If completing the year is a condition to receiving your bonus, then you are likely not entitled to receive it. If there is no such language, then you are entitled to believe that completing the year was not a requirement to receiving your bonus. Therefore, you will likely be entitled to your bonus.
3
Is the language ambiguous?
In addition to looking for the specific clause above, you should also look through the agreement to see if there is any ambiguous language regarding the bonus. If there is, then the ambiguity will likely be resolved in your favor because it will be construed against the drafting party, the employer.
