A Portable Breath Test (PBT) is NOT the "official" breath testA portable breath test, otherwise known as a PBT, is typically given at the scene of a DUI arrest to help the officer decide whether or not to make the arrest. Typically officers use this breath test to "confirm" their suspicions regarding the suspect. Under Washington DUI law, you don't lose your license for refusing to take the PBT. You lose your license if you refuse to submit to the "official" breath testAt the time of this writing, the "official" breath test is the BAC DataMaster. Typically, after a DUI arrest and at the police station, an officer will read the suspect the "Implied Consent Warnings." This warning basically tells the suspect that he/she will suffer license suspension by refusing to take the breath test. See below for a link to a photo and explanation regarding the DataMaster. 3
Don't confuse the PBT with the BAC DataMasterThe PBT is a handheld device used by officers at the scene of a DUI stop to help them determine probable cause to arrest. There is no loss of license for refusing to take this test. On the other hand, the BAC DataMaster is, at the time of this writing, the "official" breath test. It is a big machine usually located at a police station. Refusing this test after being advised of the Implied Consent Warnings does result in license suspension. |
