Custody of Minor Children in Georgia Family Law Cases

The standard utilized for determining custody of minor children in Georgia is the “best interest of the child". This standard gives the courts a broad amount of discretion in determining which parent receives legal and/or physical custody of the minor children and the appropriate amount of parenting time and visitation rights for each parent. Decisions regarding custody also define the role that each parent will play in making major decisions regarding the minor children, particularly regarding health care, education, extracurricular activities and religious upbringing. It is always ideal to attempt to reach an agreement where both parties can co-parent for the sake of the children. Unfortunately, this is not always possible in every case.
