Can I Claim My Attorney’s Fees from My Spouse in the Divorce?
In Colorado, the Court may order your spouse to pay a reasonable amount for attorney’s fees. This decision is based on the financial state of both you and your spouse as well as the necessities of the case. The purpose is to equalize the position of the parties in the divorce litigation.

How do I go about getting an attorney fee award?
You make a request for temporary attorney fees at temporary orders. Alternatively you may file a Motion for Attorney Fees and Expert Costs prospectively. Your spouse has the right to respond and demand a hearing. The Court will then make a determination as to whether you are awarded fees and the amount of such an award. Finally you may also request an allocation of attorney fees and costs at the Permanent Orders hearing.
