A Structure Can Be Defective Even If It Passed Code
Passing an inspection performed by a municipality does not insulate a builder from a construction defect claim. The reason for this is the standards are different. When a structure is inspected by a municipality, the purpose is to make sure it meets health and safety standards, i.e., that it is safe. However, a structure is defective if it is constructed in such a manner as to fall below the reasonable standard of care for a builder in the area.

New construction is warranted against certain defects for 10 years. Reputable builders will honor this warranty. If the builder does not acknowledge that the work is defective, or refuses to correct the defects in the appropriate manner, a lawsuit may be necessary. As construction defect lawsuits are both hard fought and technical, an experienced defect attorney should be retained.
