If you have a Short Sale are you covered by the Mortgage Forgiveness Debt Relief Act?

The short answer is yes. If the debt is otherwise qualified debt that was used to buy, build, or substantially improve your personal residence, it is covered just as though you went through a foreclosure or debt restructuring.

If you have refinanced your personal residence is it covered by the Mortgage Forgiveness Debt Relief Act?

Again the short answer is yes. If the debt that was refinanced was qualified debt that was used to buy, build, or substantially improve your personal residence, it is covered just as though you went through a foreclosure or debt restructuring.
