If you are injured by a drunk driver in a car or truck accident in Alabama you may have a claim against not only the drunk driver but the bar, restaurant or store that served or sold him/her the alcohol. The state of Alabama has laws in place that regulate the sale and distribution of alcoholic beverages. These statutes are known as Dram Shop laws,and prohibit the sale or distribution of alcohol beverage to someone who under the totality of the circumstances appears to be intoxicated. This means if a customer comes into a bar, restaurant or store and appears intoxicated or drunk the store has a legal duty to refuse to serve and/or sale alcohol to this person. By violating this law the bar, restaurant and/or store can be held liable for the damages caused by the drunk. For example, if a bar over serves a patron and he goes out and gets into a car wreck the injured person would have a potential claim against not only the drunk driver but against the bar that sold the drunk the alcohol.
Does CA law requires each driver of a vehicle who was involved a car accident with bodily injury consent to have blood drawn?
