A man in Rockland County, New York won $750,000 from a jury award, plus $24,021 to compensate him for medical expenses according to a press release. The man was injured during an abdominal surgery. The surgery ended up injuring his ureter. The surgery was done for diverticulitis. Following the surgery, the man was discovered to have urine in his abdomen, the result of a hole in his ureter.
As a result of the condition, the man suffered enormous pain and suffering and had to go through additional procedures, though he did eventually recover.
When surgeries go wrong, patient sometimes end up suing for malpractice. There are, unfortunately, plenty of cases when the patient cannot sue and when their families have to sue the doctor, hospital or another entity over the wrongful death of their loved one. Even though modern surgery is much safer than it has ever been, there is still very real risks that go along with getting any surgical procedure performed. A patient going through surgery accepts reasonable risks as a result of their procedures, they do not have to accept negligence.
In order to sue for medical negligence, some sort of harm has to have been done. You cannot sue for medical negligence simply because you are unhappy with a doctor's bedside manner, for instance. If whatever procedure the physician ordered or performed ended up causing you real harm, that is when there may be an opportunity to file a lawsuit for medical negligence and recover damages for what you have been put through.
Pain and suffering, mental anguish, the loss of quality of life and other types of damages are oftentimes added to these lawsuits. The costs of the medical expenses involved, of course, will always be added to the amount being sought in damages. A jury may decide to award you some, all or none of the money you are seeking. If your case is particularly strong, you may be offered a settlement by the physician's insurance company, and your own legal representation will help you to negotiate a fair sum in these instances.
A medical malpractice wrongful death attorney can sit down with you and discuss whether or not it seems like you may have been the victim of malpractice. This is not always clear-cut. There are, however, limitations on how long you have to file one of these lawsuits after the incident, so it is always advisable for you to file as soon as possible.
