Who must initiate a private adoption?

I had a child with a man who currently has no part in my child's life. He wants to give up his rights to my spouse which we are in agreement with. Can he initate the adoption since he is paying for it even though he is giving up the rights?

    Answered . No. He can pay for it but cannot initiate it. Adoption is a petition to the court by the person wanting to adopt. The exact process is delineated by state law, and varies from state to state. Normally your husband would be the petitioner. Step parent adoptions are straightforward if the biological father consents.
