WAS WITH SOME FRIENDS AND THEY WERE GETTING WILD. BUT NOTHING HAPPENED EXCEPT I WAS SURE WE WOULD GET STOPPED AND NOW I WANT TO KNOW MY RIGHTS.
You can, and should, refuse all testing, Refuse to answer any questions. Any questions at all about your past whereabouts, about whether you have been drinking and how much, about where you are going - ANYTHING. When asked if you know why the cop pulled you over, answer "no," because you don't. When being questioned, your only answer(s) should be "I don't answer questions...I don't do tests...officer am I being detained or am I free to...officer, I am not going to answer questions without speaking with a lawyer." If you are arrested and refuse a breath test it is no big deal they have to set you up at the DMV with a refusal hearing and only if you lose the refusal hearing your license will be suspended for 1 year. But, it is better than giving them evidence to charge you with in court.
Under the law you are required to do the breath test. If you refuse your license will get suspended. The police can also get a warrant to draw your blood. Whether to take the test can be complicated and depend on how drunk you are, whether you had an accident and what County you are in just to name a few.
