w/o seeing school zone flashing light can police write speeding tickets

I was doing 31 in a 30 mph zone. The school zone sign said if light is flashing or children are present 20mph. There was no children present but the officer could not see if the light was flashing as she was down the road pointed in the opposite direction and could not see the light or the sign at all. Could I fight on the premuse that she cound not prove that the light was flashing and would have to go with there was no children present as the sign stated.
