FlagMY MOTHER PASSED IN JAN. 20012. THE BROTHER WHO IS SUPPOSED TO BE THE EXECUTOR OF HF THE WILL WIIL NOT GIVE HIS BROTHERS ANY INFO.IT HAS BEEN 10 MONTHS
You would have to ask an attorney in TN. In Alabama, which follows the Uniform Probate Code, you have 6 moths from the date the will is filed for probate. As an heir (son), you would have to be notified when the will is filed for probate. There is no deadline to file a will, however, a will is not valid (in Alabama) 5 years after the date of death.
Get an estates attorney immediately. Secrecy is never a good thing and may be indicative of greater problems. Looting of an estate would be something to be concerned about at this point. Lawyer up today!
