Ok i didn't make a payment on my car rite and i whent to pick up my children from school and when i came back the car was gone and the finance company told me it was them that took it but how would they find me so quick when my wife told me there were at our house asking for me just a couple minutes back. Thats why am here today asking if its legal for a finance company to put a tracking device on my car?
I know of a statute that restricts rental car companies from using GPS devices on their cars without adequate disclosure (CA Civ. Code § 1936(6)(o) (2002), but no restriction on car lenders. Check your finance agreement - it may include this, in which case you agreed to it. It may also be a contractual remedy you've agreed that they have in case their repossession rights are triggered because you failed to make the promised payments.
