Is it legal for me to post pictures that users upload to my website?

I understand that the rights to a photo belong to the person that took it. If I have a waiver on my site saying I assume the poster has the rights to the photo he/she is posting, am I shielded from lawsuits? Can the person actually in the picture (not the poster) sue me for posting their image? What about if the photo may be deemed derogatory? Finally, are pictures on sites such as facebook and flickr under different arrangements? Can re-publish these photos?

the thing you need to have is appropriate terms and conditions. normally, sites hosting user generated content disclaim any rights in the content posted by users, however, users grant a perpetual universal license to the website allowing the content to be displayed on the website. this way, the site gets the benefit of the content without the downside of liability - something also granted to websites by section 230 of the communications decency act safe harbor provision.

The waiver on its own would not be enough, as lack of knowledge of copyright protection is not a defense to infringement though it may help you on the issue of damages. Since your site merely allows others to post content it may be protected by the Digital Millenium Copyright Act which would mean that anyone alleging infringement would first have to issue you a cease and desist letter and only if you were to fail to comply would you be subject to a lawsuit. You should however also continue to obtain the waivers and to have the protective language on your website

The answer is for copyright purposes, a qualified yes, given the notice and take down provisions of the Digital Millenium Copyright Act. You should familiarize yourself with that law and how it provides a limited safe harbor if you are contacted by a copyright owner for something a user posted. I would also make sure that you have a clear DMCA policy recited in your terms of service agreement. Also, I would try not to independently post or repost user submitted photos as that might expose you to copyright liability that falls outside the DMCA safe harbor. As for the rights of the people in the pictures themselves, their potential rights of publicity could subject you to liability. Again, you want a solid terms of service agreement that demands the users warrant and represent they have the rights to post the photos in question. You also want to familiarize yourself with section 230 of the Communications Decency Act. That safe harbor for defamatory content by users will be of great interest to you.
