In a case of no insurance is the registered owner liable even if the driver was their son who is 21?

I was in an accident were my friend was driving we didn't hit anything nor were we hit but he was drinking alittle and lost control ... We flipped and I was taken to the hospital with a broken arm... He said that his insurance doesn't cover the accident becuase he only had collision. Am I allowed to sue his dad who is the registared owner or do I have to sue the driver?

You should not be suing anyone without an attorney. Since you have been injured, you should consult a personal injury attorney. The owner of the vehicle is liable, at least up to $15K, along with the negligent driver. The owner could be liable for more under the theory of negligent entrustment.

You have two years to file a personal injury action in CA. Your attorney will, in nearly all cases, attempt to settle the case prior to a lawsuit being filed. Good luck.

You have the right to sue a drive and an owner. However the owner's damages may be limited by the CA. Veh. Code to $15,000. Since you suffered a broken arm, and are being told that there is no insurance, you should retain a personal injury lawyer to help you sort out your rights and remedies.
