I am with Company A. When I go to Company B I will meet Bsc and 5yrs experience. And the job in Company B will most likely meet that criteria.
Problem is considering that there are different stages, PERM - PWD request to DOL - ETA 9089 - I140 - I485.
- At what stage will u be able to go to Company B and still retain previous GC application? I485 0r I140?
- Since it was initially under EB3, will I be able to change to EB2 with Company B since I now meet EB2 or I have to sart afresh since it is a new job?
- What are the criteria that allow you to transfer GC besides same job description?
- Can I cancel the old one (GC from Company A) and start afresh if I had already got to the I140/I148 stage? Since it will still be faster than the old application
EB3 in my country is 01 May 2006
If your I-140 is approved with Company A, you can file a new PERM with Company B and retain the priority date, so you probably won't want to abandon/cancel an already approved I-140. If the new job meets the qualifications required for EB2, then yes, you can file a new PERM under EB2. If you have an I-485 filed and pending for more than 180 days with Company A, you can move to another company doing the same thing.
