Hi , I got the rejection on I94 extension today pertaining to 1 B visa . My 1 B and I94 had got expired one month back . Will this out of state period of one month affect new 1 B filing from India ? When can I apply for a fresh 1 B visa now ?

You can file as soon as you get back. But they will have a record/you will need to disclose the rejection. In the rejection notice there are instructions as to when you need to leave the country. You may consult with an Immigration attorney to see what your options are.

You need to return to India to get a new H-1B visa. Don't worry about the one month overstay.
