My latest fine is all paid off and Iam being very honest and cooperative... will I be facing jail the this time? is there any plea I can give to avoid jail time? If you have two prior theft convictions a third offense can be charged as a felony. It's not mandatory to be charged as a felony but it is allowed. Felonies a maximum of five years in prison. There is no minimum sentence on a felony theft. Still, the prosecutor may offer any number of resolutions that would avoid a felony charge and would avoid jail time. Your best bet is to get an excellent attorney onboard immediately. They will be able to help you defend the case and negotiate with the prosecutor.

I have very limited information about your case and I am not your attorney. If you want to discuss your situation in more detail, you can contact me directly.

  2. Ask for a Public Defender and why are you doing this? Are you a kleptomaniac? I think you need some counseling. You seem to be unable to stop acting on impulse.

My name is Stephen R. Cohen and have practiced 39+ yrs. I can be reached at 213-819-1171. I practicein Los Angeles and Orange County, CA. I give only appointments over the phone., these services do not create an attorney client relationship. My answers may offend as I do not believe in pulling punches or sugar coating the truth, I use common sense as well as the law. Other state's laws may differ and I would appreciate it if you feel like marking my answers helpful or best. There are a lot of really good attorneys on this site, I will do limited appearances which are court documents , less expensive.
