I'm a US citizen and I want to petition for my husband who has a 10 year bar can I petition for him or he must wait 10 years?

My husband has completed 5 years of the 10 year bar as his wife can I petition for him?

    Answered . Need more facts. If he returned to the U.S. unlawfully after being deported, or after being unlawful present in the U.S. for over one year, he cannot apply for a waiver to return until he has spend 10 years abroad.
