My friend allowed her minor daughters to stay with me when she went in a drug rehab. cps was notified and said ok. cps will b closing her case this week.she is out of rehab but feels she cant care for children. she would like me to take legal custody. father is in drug rehab and would also consent. How do we go about doing this? Do we have to have a lawyer?
In most states, you need a family lawyer to petition the court to have you officially named as guardian. Get with such an attorney who regularly handles these matters.

Yes-you would need attorney to file guardianship petition. It would be best for you to have full control as guardian of child instead of custody.
