Same sex marriage
My husband filed for & has been approved for disability/Social Security benefits due to an injury.
Upon filling out his paperwork to obtain these he was told that he needed to file as being "Single" versus "Married" since Social Security benefits are federal & not state since same sex marriage is not recognized. However, for the past 2 years the IRS has kept my refund due to him owing back child support. We filed jointly. Social Security/Disability has retro'd him back pay for the past two years. MY income was not added to this since federal failes to recognize us as married (confusing since IRS is federal & took my refund). I held him for the past two years on our taxes. Why wouldnt Social security/Disability add my income if I am still working and providing for us
